Acceptance of the General Conditions

The General Conditions outlined below regulate the use of the AFAPIC Website. The use of the AFAPIC Website attributes the status of “User” and implies full and unreserved acceptance by the User of all the General Conditions published at the time of access. Therefore, the User is recommended to carefully read the content of the GENERAL CONDITIONS each time they intend to use the website.

Ownership and Service Provider

AFAPIC, as the owner of this website and provider of information society services, in accordance with current legislation on Information Society Services and Electronic Commerce (Law 34/2002, of July 11, LSSI-CE), makes the following general information available to users:

Scope of Application

The LSSI applies to the following services offered via the Internet when they constitute an economic or lucrative activity for the service provider:

• E-commerce.

• Online contracting.

• Information and advertising.

• Intermediary services.

Economic activity is deemed to exist when the website owner receives direct income (from e-commerce activities) or indirect income (from advertising or sponsorship). In principle, the LSSI does not apply to non-profit activities (political parties, unions, NGOs, etc.) as long as they do not constitute an economic activity. AFAPIC is responsible for the website and provides this document to comply with the obligations set forth in Law 34/2002 (LSSI-CE), Law 7/1996 on Retail Trade, and Law 3/2014 amending the General Law for the Defense of Consumers and Users.

Applicable Law and Jurisdiction

These general conditions of use and contracting are governed by Spanish Law. In accordance with Article 29 of Law 34/2002, electronic contracts between businessmen or professionals, in the absence of a pact between the parties, shall be presumed to have been concluded at the place where the service provider is established. In the event of a dispute, the parties submit, at their free choice and waiving any other jurisdiction, to the courts and tribunals of the domicile of AFAPIC, as provided in this Legal Notice (Madrid).

Denial and Withdrawal of Access

AFAPIC reserves the right to deny or withdraw access to its website at any time and without prior notice to users who fail to comply with these General Conditions or any applicable specific conditions.

Legal Information on Data Collection

In compliance with Organic Law 15/1999, of December 13, on the Protection of Personal Data (LOPD), Royal Decree 1720/2007, of December 21, which approves the Regulation for the development of Organic Law 15/1999, and with a view to complying with Regulation (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data (known as GDPR), which became mandatory for member countries as of May 25, 2018, users are hereby informed that the personal data requested in our forms or provided to us via our email addresses will be included in our personal data files, for which AFAPIC is the owner and data controller.

By registering at https://congresoafapic.es and using our website or any other information provided as part of AFAPIC’s services, the user accepts and subscribes in a binding manner to AFAPIC’s terms of use, which are incorporated by reference into these Terms and Conditions.

Furthermore, by filling out any form with the requested personal data and accepting its submission—whether through the use of the various products or services offered on this website or by sending an electronic message with personal data—the user expressly authorizes and consents to AFAPIC processing and incorporating such data into our files. These files are duly registered with the Spanish Data Protection Agency (AEPD, www.aepd.es), under the responsibility of the aforementioned company, for the purpose of providing further information about the company and informing users about products and services offered.

The user guarantees the authenticity and veracity of all data communicated, whether in filling out information request forms, quote requests, purchases, reservations, etc., or at any subsequent time. It is the user’s responsibility to update the information provided so that it reflects their actual situation. The user shall be liable for any inaccuracy or lack of veracity in the information provided.

AFAPIC has adopted the necessary technical and organizational measures to protect the Personal Data it collects and processes automatically, in accordance with current regulations on personal data protection.

AFAPIC undertakes, in all cases, to process personal data in accordance with the Law and current data protection regulations, as well as to establish the relevant confidentiality agreements with third parties to whom it transfers or allows access to this personal data.

AFAPIC reserves the right to modify any type of information that appears on the website without the obligation to give prior notice to users; publication on the provider’s website shall be deemed sufficient.

Obligation to Use the Website and Contents Correctly

All content included on this Website is provided for informational purposes only. Under no circumstances shall such content serve as a basis for appeals or claims, nor shall it constitute a source of rights. AFAPIC reserves the right to modify the contents of the Website without prior notice.

The User undertakes to make correct use of the Website and the utilities provided to them in accordance with the law, this legal document, and any instructions and notices communicated to them.

The User is obliged to use the Website and all its contents exclusively for lawful and non-prohibited purposes that do not infringe upon current legislation and/or may be harmful to the legitimate rights of AFAPIC or any third party, and/or that may cause any direct or indirect damage or prejudice.

To this end, the user shall refrain from using any of the contents of the Website for purposes or effects that are unlawful, prohibited in this Legal Document, harmful to the rights and interests of third parties, or that may in any way damage, disable, overburden, impair, or prevent the normal use of the Web.

In particular, and by way of indication only and not exhaustive, the user undertakes not to transmit, disseminate, or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material that:

• In any way is contrary to, belittles, or attacks fundamental rights and public freedoms recognized constitutionally, in international treaties, and in other legislation;

• Induces, incites, or promotes criminal, disparaging, defamatory, libelous, violent actions or, in general, actions contrary to the law, morality, and generally accepted good customs or public order;

• Induces, incites, or promotes discriminatory actions, attitudes, or thoughts by reason of sex, race, religion, beliefs, age, or condition;

• Incorporates, makes available, or allows access to products, elements, messages, and/or services that are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, morality, and generally accepted good customs or public order;

   

• Is false, ambiguous, inaccurate, exaggerated, or untimely, such that it induces or may induce error regarding its object or the intentions or purposes of the communicator;

   

• Is protected by any intellectual or industrial property rights belonging to third parties, without the User having previously obtained the necessary authorization from their holders;

• Violates the business secrets of third parties;

• Is contrary to the right to honor, personal and family privacy, or a person’s own image;

• In any way undermines the credit of AFAPIC;

• Infringes the regulations on the secrecy of communications;

• Constitutes, where applicable, unlawful, misleading, or unfair advertising and, in general, unfair competition;

• Incorporates viruses or other physical or electronic elements that may damage or prevent the normal functioning of the network, the system, or computer equipment (hardware and software) of AFAPIC or third parties;

• Causes difficulties in the normal functioning of the Service due to its characteristics (such as format, extension, etc.).

The user also undertakes to refrain from:

• Reproducing, copying, distributing, making available or in any other way publicly communicating, transforming, or modifying the Contents, unless authorized by the holder of the corresponding rights or if it is legally permitted;

• Deleting, manipulating, or in any way altering the “copyright” and other identifying data of the reservation of rights of AFAPIC;

• Attempting to obtain the Contents using means or procedures other than those that have been made available for this purpose or have been indicated on the Website for this purpose.

The user shall be liable for damages of any nature that AFAPIC may suffer, directly or indirectly, as a result of a breach of any of the obligations derived from the general conditions or the law in relation to the use of the Website.

Duration of Service

AFAPIC does not guarantee the availability or continuity of the Website’s operation. Whenever reasonably possible, AFAPIC will provide prior notice of any interruptions in the functioning of the Website. Furthermore, AFAPIC does not guarantee the utility of the Website for performing any specific activity, nor its infallibility.

Access to the AFAPIC Website is of indefinite duration; however, AFAPIC reserves the right to suspend access, without prior notice, to users who, in its judgment, fail to comply with the rules of use of its website, and to take appropriate legal action. Additionally, AFAPIC reserves the right to restrict access to certain sections of the Website to the general public, limiting it only to specific users or groups of users through the issuance of an access password, for which they shall be held responsible.

Exclusion of Liability

AFAPIC makes every effort to avoid any errors in the contents of the Website but does not guarantee or accept responsibility for potential errors in said contents.

AFAPIC excludes any liability for damages of any nature that may eventually derive from:

• The interruption of operation or lack of availability of access to the Website.

• Privacy and security in the User’s use of the Website, and/or unauthorized access by non-consented third parties.

• The eventual transmission of elements that negatively affect computer systems.

• The accuracy, completeness, and timely updating of the contents of its Website. Consequently, AFAPIC does not guarantee the reliability, availability, or continuity of its Website or its contents; therefore, the User’s use of the same is carried out at their own risk, and AFAPIC may not be held liable in this regard at any time.

AFAPIC shall not be liable in the event of service interruptions, delays, errors, malfunctions and, in general, other inconveniences originating from causes beyond AFAPIC’s control and/or due to willful or negligent actions by the User and/or originating from causes of force majeure. In any case, regardless of the cause, AFAPIC shall not assume any liability for direct or indirect damages, consequential loss, and/or loss of profits. AFAPIC shall have the right, without any compensation to the User for these concepts, to temporarily suspend the services and contents of the Website to carry out maintenance, improvement, or repair operations.

AFAPIC excludes any liability for damages of any nature that may be due to the lack of truthfulness, accuracy, completeness, and/or timeliness of the contents transmitted, disseminated, stored, made available, or received, obtained, or accessed through the Web; nor for contents provided by third parties or entities.

AFAPIC will attempt, as far as possible, to update and rectify information hosted on its Website that does not meet minimum guarantees of truthfulness. However, it shall be exempt from liability for its failure to update or rectify, as well as for the contents and information posted therein.

AFAPIC is not responsible for the User’s use of the Website’s services, products, and passwords, or any other material on the Website that infringes upon intellectual or industrial property rights or any other third-party rights.

AFAPIC reserves the right to remove any content that is untruthful, inaccurate, or contrary to the law, morality, public order, and good customs.

Governing Law and Jurisdiction

The provision of the service is governed by Spanish law. The Courts of Madrid shall have jurisdiction over any dispute, and the User expressly submits to said jurisdiction.
